The Federal Trade Commission on April 23, 2024 adopted a broad regulation that will void employer contracts, workplace policies, and compensation arrangements that prohibit, penalize, or in practice prevent a worker from working elsewhere (save for a few limited exceptions) when – and if – the ban goes into effect as scheduled in mid-August 2024. This alert highlights the primary questions that an organization must answer to determine whether and to what extent the ban applies. The firm will be presenting a webinar on May 9, 2024 at 1 p.m. describing the rule in greater detail and sharing practical recommendations how businesses can prepare.

On April 22, 2024, the U.S. Department of Health & Human Services, Office for Civil Rights (OCR) announced a final rule, titled HIPAA Privacy Rule to Support Reproductive Health Care Privacy (Final Rule). The rule will become effective 60 days after formal publication in the Federal Register, with a final compliance deadline of 240 days after publication, except for certain requirements that must be complied with by February 16, 2026. The Final Rule was instituted in direct response to the U.S. Supreme Court’s 2022 decision in Dobbs v. Jackson Women’s Health Organization overturning precedent that protected a constitutional right to abortion, thus altering the legal and health care landscape in the United States. The rule also supports President Biden’s Executive Orders, including EO 14076, on protecting access to reproductive health care.

In the early 1970s, Eichler paved the way for the establishment of many New Jersey healthcare “firsts” by shepherding the licensing of the first non-hospital-owned, free-standing dialysis facility, the first MRI, the first free-standing ambulatory surgical center, and the first lithotripter. He was also the first attorney to represent a medical staff in New Jersey. The firm, which had relocated to East Orange and then Roseland, NJ, later merged with WolfBlock Schorr & Solis-Cohen LLP in 2003. In April 2009 after announcing its plans to disband, the Roseland attorneys of WolfBlock formed Brach Eichler.
