The Federal Trade Commission on April 23, 2024 adopted a broad regulation that will void employer contracts, workplace policies, and compensation arrangements that prohibit, penalize, or in practice prevent a worker from working elsewhere (save for a few limited exceptions) when – and if – the ban goes into effect as scheduled in mid-August 2024. This alert highlights the primary questions that an organization must answer to determine whether and to what extent the ban applies.
